These Standard Terms and Conditions of Sale (referred to as "Terms") govern the sale of tours, activities, accommodations, and services (referred to as "Services") provided by ISLE IMPRESSIONS (referred to as "the Company") to its clients (referred to as "Clients"). By purchasing or participating in any Services offered by the Company, Clients agree to be bound by these Terms.
Booking and Payment:
a. Booking: Clients can make a booking for the Services offered by the Company through various channels, including online platforms, email, or telephone. The booking is considered confirmed once the Company provides a booking confirmation to the Client.
b. Payment: Clients are required to make full payment or a specified deposit at the time of booking, as outlined in the booking confirmation. Payment methods accepted by the Company may include cash, bank transfer, credit/debit card, or other approved payment options.
Cancellations and Refunds:
a. Client Cancellations: Clients may cancel their booking by providing written notice to the Company. Cancellation fees may apply, and the amount refunded will depend on the time of cancellation relative to the scheduled start date of the Service. The Company's cancellation policy, including any applicable fees and deadlines, will be communicated to the Client during the booking process.
b. Company Cancellations: In the event that the Company needs to cancel a Service due to unforeseen circumstances, such as weather conditions, safety concerns, or insufficient participation, the Company will provide alternative options or a full refund to the Client.
Changes to Bookings:
a. Client-Requested Changes: Clients may request changes to their booking, such as a change in travel dates, participant names, or other details. The Company will make reasonable efforts to accommodate such requests, subject to availability and any applicable fees or costs associated with the changes.
b. Company-Initiated Changes: The Company reserves the right to make changes to the itinerary, schedule, or other aspects of the Service due to operational reasons, including but not limited to weather conditions, supplier availability, or safety considerations. In such cases, the Company will notify the Client as soon as possible and provide suitable alternatives or a refund if necessary.
Client Responsibilities:
a. Travel Documents: Clients are responsible for obtaining and ensuring the validity of all necessary travel documents, including passports, visas, permits, and health certificates required for the destination(s) of the Service.
b. Health and Insurance: Clients are responsible for assessing their fitness and suitability for the Service and ensuring they have appropriate travel insurance coverage that includes medical expenses, trip cancellation, and personal liability.
c. Compliance: Clients are expected to comply with local laws, regulations, customs, and any instructions or rules provided by the Company or its representatives during the Service. Failure to comply may result in termination of participation without refund.
Limitation of Liability:
a. The Company acts as an intermediary and organizer of the Services provided by third-party suppliers. The Company shall not be liable for any acts, omissions, negligence, delays, damages, or losses arising from the provision of the Services by these third-party suppliers.
b. The Company's liability for any claims, damages, losses, or expenses arising from the purchase or participation in the Services shall be limited to the amount paid by the Client for the specific Service in question.
c. The Company shall not be liable for any indirect, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or reputational damage.
Governing Law and Jurisdiction:
a. These Terms shall be governed by and construed in accordance with the laws of The United Republic of Tanzania.
b. Any disputes or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Zanzibar.
By purchasing or participating in any Services offered by the Company, Clients confirm that they have read, understood, and agreed to these Standard Terms and Conditions of Sale.
